Anne C. Martin concentrates her practice in the areas of commercial litigation and employment law, representing both employers and employees. She represents many different companies and individuals with a variety of business problems.
Anne on… law, life and passion.
A preeminent Nashville employment lawyer, Anne has been widely published in the areas of employment law as it relates to matters including discharge, disability leave, discrimination, harassment and non-compete agreements. She also served as a guest lecturer at the Belmont University Center for Entrepreneurship during the fall 2009 and spring 2010 semesters, applying her expertise to a Venture Management class.
Anne loves being a lawyer and attributes that to excellent mentoring by lawyers who taught her how to provide good client service, how to appropriately and effectively communicate with her clients, and what was expected of her by judges before whom she appears.
Anne is proud of the clients she has helped over the years and of the recognition she has achieved for her leadership among her peers (see awards). She prides herself on being a problem solver, whether that means litigation or negotiation. She is especially skilled at taking a client’s problem, analyzing it, determining the best means of achieving the client’s objective, all while keeping in mind the type and size of the issues involved.
In addition to practicing law, Anne is active in her local community. She recently served on the Mayor’s Advisory Council on Early Childhood Development and Education, and is currently on the board of First Steps, Inc. Previously she has served on the boards of a number of nonprofits that help the poor and children. As much as Anne enjoys her profession, she feels an obligation to give back to the community and to use the special gifts she has developed as a lawyer to help others who cannot help themselves.

John A. Day has lived in Middle Tennessee for the last 30 of his 55 years. After graduating with honors from the University of North Carolina School of Law at the age of 24, he moved to Nashville and practiced law with a major Nashville firm. He gave up a partnership in that firm to start his own firm at the age of 36 – a firm now known as one of the leading personal injury and wrongful death law firms in Tennessee.
John’s law practice consists solely of civil litigation. Historically, he has represented plaintiffs in the personal injury and wrongful death field, but his practice has included commercial litigation. One example of the breadth of his practice is his recognition in the 2007 through 2013 editions of Best Lawyers in America in five different areas – Bet-the-Company Litigation, Medical Malpractice Litigation, Commercial Litigation, Products Liability Litigation, and Personal Injury Litigation. 2013 marks John's twentieth year being listed in Best Lawyers. In 2009, Best Lawyers named him the first ever "Lawyer of the Year for Personal Injury Litigation - Nashville." John was also named by Best Lawyers as "Lawyer of the Year for Medical Malpractice Law - Nashville" in 2010 and "Lawyer of the Year for Bet-the-Company Litigation - Nashville" in 2012.
John is married to Joy Burns Day, a lawyer in Franklin, Tennessee, and is the father of three children – Sarah, Michael and Kate. The family lives in Williamson County, Tennessee and spends as many weekends as possible at their cabin on Tims Ford Lake outside of Lynchburg, Tennessee. John enjoys politics, writing, reading, hiking and water sports.
Professional Honors
John’s first professional honors were achieved in law school, where he was elected to the staff of the North Carolina Law Review and the Order of the Coif.
At the age of 36 he received his first recognition in Best Lawyers in America, and has been included in every edition of the publication since 1993. That same year he was honored with an AV rating by Martindale Hubbell, a rating which continues to this day. The Martindale publication also has awarded John a 5.0 on its numerical rating score, the highest possible rating.
John was board-certified in civil trial practice by the National Board of Trial Advocacy, served as that organization’s President in 2003-04, and was called back into service as its Treasurer for the 2008-09 fiscal year. Less than 150 lawyers in Tennessee have earned this certification. John is also board-certified in Medical Malpractice by the American Board of Professional Liability Attorneys.
Other than representing hundreds of wonderful clients in the past 28 years, John’s greatest professional honor was achieved in 2002 when he was elected as a Fellow in the American College of Trial Lawyers. This international organization includes many of the best-known, highly respected trial lawyers in the country. Less than 200 lawyers in Tennessee have been elected to membership in this organization.
John is routinely included in Best Lawyer lists in Nashville and Tennessee, and has been named in Mid-South Super Lawyers Top 100 every year since 2006. He was recently named one of Nashville's Top 101 Lawyers for 2011 by the Nashville Post.
Professional Activities
John believes that lawyers have a duty to serve not only their clients but also to work to enhance the profession and the law. John served as President of the Tennessee Trial Lawyers Association (now the Tennessee Association for Justice) in 1993-94 and served as Chair of the Council of State Presidents of the Association of Trial Lawyers of America (now the American Association for Justice) from 1994-95. He has served on the Board of Directors of the Nashville Bar Association and as Chair of the Tennessee Bar Association’s Tort and Insurance Practice Section.
John has also been selected by the Tennessee Supreme Court to serve on three important commissions. He served on the inaugural Commission on Alternative Dispute Resolution, which drafted the first ADR rule (Rule 31) for the Tennessee Supreme Court. He served for six years on the Commission for Continuing Legal Education and Specialization, served as its Chairperson, and was awarded the Commission’s "Leadership in Attorney Specialization" award in 2006. He currently serves on the Court’s Commission on Rules and Procedure.
John also served on the Tennessee Judicial Evaluation Commission as an appointee of former Lt. Gov. John S. Wilder. That service ended in the Summer of 2009 when the General Assembly allowed the statute creating the Commission to "sunset." A new evaluation commission was created by the General Assembly in 2009, and John was appointed to serve on it, this time by the Speaker of the House, Rep. Kent Williams. John was elected as the first Chair of the new Judicial Performance Evaluation Commission in September 2009.
Professional Writing
John’s first book, Tennessee Law of Comparative Fault, was written in 1998 and co-authored with Donald Capparella. The book is now in its third edition and is published by Thomason-West. John D. Wood joined as a contributing author at the time the second edition was published. The book is updated annually.
John’s second book was published in 2008. A new edition of the book, Day on Torts: A Handbook for Tennessee Tort Lawyers, was published in 2009. The third edition, Day on Torts: Leading Cases in Tennessee Tort Law, was published in 2010.
John is the founder of the Tennessee Tort Law Letter and served as its editor for over a decade. He started his own monthly publication, which he co-authors with Brandon Bass, in November 2008. Called the Tennessee Trial Law Report, the subscription-only newsletter addresses changes in the law of torts, civil procedure and evidence. The newsletter is read by lawyers and judges across the state.
John has also written over 50 articles published in peer-reviewed publications. Click here for a list of those publications.
Professional Speaking
John has been honored with invitations to speak to lawyers about tort law and other issues of interest to tort lawyers on over 250 occasions. He has given over 200 speeches in Tennessee, as well as speeches in Alabama, Arkansas, British Columbia, Florida, Georgia, Hawaii, Illinois, Kentucky, Louisiana, Massachusetts, Michigan, Mississippi, Missouri, Nevada, New Mexico, New York, North Carolina, Ohio, Puerto Rico, Texas, Washington, D.C. and Wisconsin. Click here for a list of those speeches.
John is also co-owner of a seminar company called Justice Programs. One of the largest continuing legal education providers in Tennessee, Justice Programs offers 15 hours of continuing education to Tennessee-licensed lawyers every fall in three Tennessee cities – Nashville, Knoxville and Memphis. John speaks approximately four hours at these programs per city per year on tort law, comparative fault, and other topics.
