Susan Dierenfeldt-Troy handles the business law and intellectual property law practice areas for the firm. William J. Troy, a native of New York City, co-founded Troy and Schwartz, LLC with his partner, Jon D. Schwartz, in the early 1990s. Ivis Mendoza is a paralegal who has over 10 years of work experience in this profession. She studied at Miami Dade College, an ABA approved school, and in 2003 she earned an Associates of Science in Legal Assisting.  She continued her education and in 2007 graduated from Nova Southeastern University  with a Bachelors of Science in Business Administration. Ivis has been employed at Troy & Schwartz, L.L.C. since 2006 and is fluent in both English and Spanish.
Frank has served the legal needs of clients since 1954. Admitted to the Tennessee Bar and the Bar of the U.S. Supreme Court, he is a Roscoe Pound Fellow, founding member of the American Trial Lawyers Foundation, and holds membership in the Nashville Bar Foundation, Williamson County Bar Association, Tennessee Bar Association, American Bar Association, the American Academy of Estate Planning Attorneys, and the American Association for Justice.
Frank has served on the Tennessee Representative Board of Directors of the National Beef Cattlemen's Association (Tax Committee) for more than 20 years. A retired Captain in the U.S. Air Force, he served as Executive Officer/Staff Judge Advocate and legal advisor to the base Commander. A judge faced with a deadlocked jury has two choices.  First, the judge can send the jury home, declare a mistrial, and order the parties to another trial.  This is an expensive option, both for the parties to the lawsuit and the justice system, because of the money that will be spent on the new trial.
The other option is for the judge to give what is known as a "dynamite" or "Allen" charge.  A dynamite or Allen charge is a jury instruction that strongly encourages each juror to reconsider his or her views and work toward compromise.  It tells jurors that a new trial will be very costly to the parties and that the jurors should work harder to solve their differences.
Under Tennessee law such a jury instruction can be given in a civil case only if the parties to the case agree to the charge.  Otherwise, the mere giving of the charge can result in the case being reversed on appeal.
Many states do not require unanimous jury verdicts in personal injury, wrongful death or other types of civil cases and thus rarely have deadlocked juries.  These states usually allow one, two or even three of the twelve jurors to disagree with the remaining jurors and the jury verdict of the super-majority is still valid.
